| 摘 要： | 指出了司法腐败是错案的主要根源;认识的主客二重性决定了错案原则上不可避免;反腐倡廉是减少错案的重要措施;加强和完善程序建设是减少错案的法律保证.强调了制定一部监督法是保证司法公正的当务之急.

| Abstract: | Judicial corruption is the main source of misjudged cases, which can hardly be avoided in principle owing to the dual character of objective and subjective understandings. To oppose corruption and remain honest and clean is an important stop of decreasing misjudged cases,and to enhance and perfect the judicial proceedings is the legal guarantee for reducing misjudged cases, It is stressed that to formulate a law of supervision is an urgent task for ensuring legal justice. |
