| 摘 要： | 证据是法院审判定案的客现依据。证据的证明标准不同时代,不同国家则所不同。在建设社会主义法治国家的进程中,我国法院如何审案。定案其证据的证明标准怎样,这切实关系着法院的审判质量。笔者认为三大诉讼中必须竖持主观和客现的统一,既强调法院的职权又应充分保护当事人的各项诉权,从而切实维护当事人的合法权益。
