| 摘 要： | 英国判例法在普通法系法律渊源中具有极其重要的地位,其茁壮成长的条件主要包括三个方面:王权的"适当"强大促成了统一的法律秩序;司法权威性和独立性的较早确立和法律职业共同体的形成使判例法得到有效的遵循和发展;经验主义的民族性促使英国选择和偏爱判例法。

| Abstract: | British case law plays a very important role in the origin of common laws. Its growth conditions mainly include three aspects：the “appropriate” power of crown contributes to the unified law orders;the early establishment of the judicial authority and independ-ence and the formation of legal professional community make the case law be followed and developed effectively; empirical nationality prompts British to choose and prefer the case law. |
