协调劳资关系,构建和谐企业——温州市私营企业劳动争议特征及对策研究

摘    要:温州私营企业劳动争议呈现案件数量及涉案人数持续增长、集体劳动争议较多、争议原因相对集中、申诉主体以劳动者为主、争议解决主要通过仲裁调解、双方部分胜诉率最高等特征,其原因涉及企业主的趋利动机、劳动者的弱势地位、法制建设不完善、监管力量不足等方面的因素。因此,需通过加强劳动立法、政府监管、用人制度建设等方面工作,减少私营企业劳动争议的发生,构建和谐的劳动关系。

Abstract:As private enterprises keep on developing, labor dispute cases of private enterprises in Wenzhou are increasing accordingly. The major features include the growing cases of collective labor dispute, and arbitration playing a more important role. The causes lie in the enterprise owners' pursuit of money, workers' weak power position, imperfectly legal system, inadequate government supervision and other elements. Therefore, it requires reinforcing a labor legislation, government inspection, and personnel system to work, in order to cut down the private enterprises labor disputes, and build harmonious labor relation.
