| 摘 要： | 组织未成年人进行违反治安管理活动罪是刑法修正案(七)规定的新罪名。组织行为的对象只要未满十八周岁即可,年龄不应该有下限要求,组织残疾人进行违反治安管理的也应该规定为该罪;组织未成年人从事的活动应包括一切"违反治安管理的"行为,而不能将其仅理解为违反《治安管理处罚法》的行为;精神病人或者未达到刑事责任年龄的人实施的有严重危害后果之行为,当然属于本罪组织行为的内容;本罪与那些把未成年人当成工具实施的犯罪之间是法条竞合或者想象竞合的关系;本罪侵犯的客体应该是复杂客体,建议将本罪规定在妨害社会管理秩序罪一章。

| Abstract: | The crime of organizing juveniles to violate public security administration is a new charge in the Amendment 7 to the Criminal Law.The relationship between this crime and those crimes which use juveniles as a tool is concurrent legal provisions,or imaginative joinder of offenses.The object of such crime should be complicated.Therefore,it is suggested that the provisions of this crime should be in the chapter of crimes of violating social order. |
