域名与商标的交叉保护冲突

“域名抢注”现象的发生使人们注意到域名与现行商标管理制度的冲突 ,如何解决域名和商标在交叉的网络世界与现实世界中的交叉保护成为本文深入探讨的课题 .本文拟从域名本身独有的特征入手 ,通过分析域名与商标法的冲突 ,以及商标与网络世界的冲突 ,初步界定双方各自独立保护的法律特征 .

Study of Conflict of Cross-Protection between Domainname and Trademark

The phenomenon that the domainname is firstly registed before its real owner to do so makes us pay attention to the conflict between the domainname and the system of the trademark management in effect.The studied deeply issue of this article is how to solve the problem of the cross*.protection between the domainname and the trademark in the crossing net world and real world.This paper intends to begin with the unique characteristic of the domainname itself and draw initial distiction between the independcatly*.protected characteristic of law of the domainname and that of the trademark by analysing the conflict between the domainname and the law of the trademark and the conflict between the trademark and net world.
