逻辑固法:对法律逻辑作用的感悟

虽然在近百年的西方法学中,逻辑的功能受到了一些学者的批判,但必须看到,法律与逻辑有着不可分割的联系。从法律方法论的角度看,逻辑规则在解释法律、论证法律的时候有固定法律意义的功能。所以,法律学人必须认真地对待逻辑尤其是形式逻辑。这对法律思维方式的形成、法制建设、法学教育等有着重要的意义。

The Force of Logic to Judicial Decision:on the Functions of Legal Logic

Although in the nearly hundred years of western legal science, the functions of logic have received some scholars' critiques, it must be acknowledged that the law and the logic have the inalienable relations with each other. In the legal methodology, the logical rules have so many functions to ascertain the significance of rule in legal interpreting and legal argumentation that the lawyers must earnestly treat the logic, especially the formal logic, which has the vital significance to the formation of legal thinking, the construction of rule by law, the legal education and so on.
