虽然在近百年的西方法学中,逻辑的功能受到了一些学者的批判,但必须看到,法律与逻辑有着不可分割的联系。从法律方法论的角度看,逻辑规则在解释法律、论证法律的时候有固定法律意义的功能。所以,法律学人必须认真地对待逻辑尤其是形式逻辑。这对法律思维方式的形成、法制建设、法学教育等有着重要的意义。
