| 摘 要： | 目前法学界对农村土地承包经营权的性质仍存在一些模糊认识，农村土地承包经营权不仅是物权，而且是与农村土地集体所有权平等的独立物权；同时，农村土地承包经营权作为物权并非传统大陆法系的私权，而是融个人利益与社会利益于一体的财产权。

Some Basic Theories of the Contract Management Right of Rural Land |

| Abstract: | There is some vague cognition on the nature of contract management fight of rural land in the jufistical circle. The contract management of rural land is not only the real fight but also a standalone real fight which is on equality with the collective ownership of rural land. Meanwhile being the real fight the contract management right of rural land is not a real fight of traditional mainland juridical system, but a property integrated individual interest with social interest. |
