儒学对晚清礼法之争的影响——以伍廷芳和张之洞为考察对象

无论是礼教派还是法理派的修律思想实践都存在继承、运用儒学文化的内容。对儒学文化的不同理解和认识促成了不同的修律思想。总体而言，伍廷芳和张之洞都继承发挥了其中“仁”、经世致用等精神。但是，张之洞视儒学为儒教，将其与封建政治紧密结合，固守其中的纲常理论，而伍廷芳则更强调儒学的社会文化意义，弱化其中三纲五常的部分，显得更为开放灵活。在修律中的表现则是：张之洞虽然积极主张并参与变法，但始终是传统伦理法内部的调节；伍廷芳则可以在继承传统法律“轻刑”、“仁爱”等思想的同时吸收现代法律中平等、尊法等内容。

The Influences of Confucian on the Argument between the Courtesy and Law in the Late Qing Dynasty： A Case Study of Chang Chih-tung and Wu Ting-fang

Whether the Ethic Faction or the Law Faction inherited and used the contents of Confucian culture to revise the laws in practice. The different understanding and awareness of Confucian cultures led to different ideas to revise the laws. Overall, Wu Ting-fang and Chang Chih-tung inherited ＇Benevolence＇, Statecraft and other thoughts. However, Chang Chih-tung saw the ＇confucian＇ as Confucianism, sticking to the Tsunatsune theory. And while Wu Ting-fang emphasisd more on social and cultural significance of Confucian, weakened the Tsunatsune factors, and seemed to be more open and flexible. Therefore, Chang Chih-tung advocated political reforms should conform with the regulation of traditional ethics while Wu Ting-fang agreed that the new laws should inherit the traditional law theories, ＂light punishmen Tsunatsune ＂, ＂love others＂ and so on as well as absorb modem ones, equality, respect for law and so on.
