西方自然法学观与中国儒家法律思想之比较

西方古代自然法与中国古代儒家思想是中西法律文化的源头。中国的儒家法律思想与西方的自然法思想及观念有着本质的区别：价值观念上“正义观”与“天道观”的分歧；治国方略上“法治观”与“人治观”的对立；权利与义务关系上权利本位与义务本位的对立；人性分析上“性恶观”与“性善观”的冲突。在市场经济的条件下，建立真正的适合社会趋向的法律制度，必须大力吸收借鉴西方的法律观念。

Comparison between Chinese Confucianist legal thought and the Western natural law concept

The ancient western natural law and the idea of ancient Chinese Confucianism isthe cultural source of law in the west and in China.Chinese Confucianist legal thought has the essential difference from the western natural law concept: the distinction on values between the " justice view" of the natural law and " God's way view" of the Confucianism;the difference on ruling statesstrategies between" the rule of law " of the nature jurist and Confucianist " the rule of people";the opposition of relation on right and obligation between the right standard of the natural legist and the duty standard of Confucianism;the collision on human nature between the view of " evil in human nature" of the western natural legist and the Chinese Confucianist "good in human nature ".In the term of market economy,establishing the real legal system that fit societal trend,must strongly absorb and draw on western legal idea.
