试论侵犯的心理机制及遏制对策

侵犯的本质特征是有意伤害他人且不为社会规范所许可。不能将侵犯等同于违法行为。在现实生活中，侵犯有多种类型。从系统论角度看，侵犯的心理机制是由生存本能、条件挫折和认知建构三个环节或关节点构成的有机运行过程。要有效遏制侵犯，应建构公众正确认知架构，建立释放个体冲动能量平台，加强对侵犯恶性样例惩戒和开展反侵犯教育等等。

On Psychological Mechanism of Infringement and Its Countermeasures

The essential characteristics of infringement is to injure intentionally, and thus prohibited by social norm. So it cannot be equated with the illegal activity. In actual life, infringement has many types. From the angel of systematology, the psychological mechanism of infringement is an organic operation course that is controlled by three links: survival instinct, term setbacks and cognition. To effectively contain infringement, such countermeasures should be adopted as constructing correct cognition, strengthening the punishment of vicious infringing cases and promoting education of anti- infringement, etc.
