| 摘 要： | 作为纠纷之一类,体育纠纷不仅具有普通纠纷的一般属性,而且具有自己的独特之处,由此形成体育纠纷的独特救济机制.考察体育纠纷的法律救济机制,主要存在两种模式,即整体制模式和分割制模式.整体制模式不区分体育纠纷的性质,统一采用一种法律救济机制解决,主要为国际奥运会所采用;分割制模式则区分体育纠纷的不同性质,采用不同的法律救济机制解决,主要为我国采用.文章最后分析了我国体育纠纷的现实解决渠道.

Relieve the Mechanism Discussion in Law of the Sports Dispute |

| Abstract: | As one kind of the dispute,general attribute not merely with ordinary dispute of sports dispute , and have one's own unique places , therefore form the unique relief mechanism of the sports dispute . Relieving the mechanism in law of investigating the sports dispute , two kinds of modes exist mainly , namely make the mode and cut apart the mode of making wholly . Make the nature that the mode does not distinguish the sports dispute wholly , adopt a kind of law to relieve the mechanism to solve in unison , adopted by international Olympic Games mainly ; Cut apart and make different nature that the mode distinguishes the sports dispute , adopt different laws and relieve the mechanism to solve , adopt for our country mainly . The reality that the article analysed the dispute of sports of our country finally solves the channel . |
