| 摘 要： | 目的探讨和分析排污权交易的经济学原理和法律价值。方法实证分析和规范分析相结合,定性分析和定量分析相结合,边际分析和经济模型相结合。结果论证了排污权交易制度理论上可行,实践中有效。论证了排污权交易是环境容量使用权交易的环境保护经济手段,以追求成本效益最大化为原则,兼顾公平和效益,是运用私法手段解决公法问题的典范。结论建议通过排污权交易的立法研究,制定具有中国特色的排污权交易制度。

| Abstract: | Aim To discuss and analyge the analyze the economic principle and legal value of exchange of the pollution draining rights.Methods Demonstration analysis is combined with criterion analysis,qualitative analysis with quantitative analysis and marginal analysis with economic model.Results Exchange system of the pollution draining rights is feasible in theory and effective in practice.Exchange of the pollution draining rights is essentially an exchange of environmental capacity right to use,which is an environmental protection economic means.Exchange of the pollution draining rights,which is based on pursuing the cost-effective to maximize and balance equity with benefit,is a model of using the private law means to solve the public law problem.Conclusion By means of changing the pollution draining rights regislation,the exchange system with chinese charwcteristics will be made. |
