| 摘 要： | 针对自然保护区立法工作中涉及管理部门多、责权关系交错复杂、各部门保护投入和利用收益冲突问题,运用演化博弈理论方法,建立部门合作关系的演化博弈模型,分析立法过程中利益部门合作的动态演变过程,重点讨论了合作产生的超额利润、合作所投入的初始成本、自然资源服务能力、贴现因子等影响系统演化行为的几个参数变化及控制方法,并根据模型分析提出了相应的对策建议。研究结果表明,各部门策略的演化方向与博弈双方的支付矩阵相关,并受到系统初始状态的影响。自然保护区立法中应正确引导各个利益主体部门趋于合作,遵从部门合作收益的极大化原则,建立良好的立法环境以及坚持长远的观点,才能建立科学合理的自然保护区法律制度,实现自然保护区保护和利用共赢的目的。该模型的建立既丰富了环境立法的理论和方法,同时为自然保护区立法实践工作提供指导。
