公平原则在证券法律关系中的有效适用

公平原则、诚实信用原则和信息公开原则是证券市场的三大基本原则,在证券法中具有举足轻重的地位。尤其在当前证券市场空前高涨的形式下,公平问题已成为亟待解决的问题。仅仅从制度及操作层面无法根本解决问题,证券法必须以公平原则为其精神内核,并贯穿于证券法运行的始终。
