论我国民事间接强制执行制度的完善

民事间接强制执行措施是我国民事强制执行措施的三大基本种类之一,在强制执行法中有着重要的地位和作用。但目前我国相关立法的规定比较落后,存在着立法条文过于原则和简单、部分强制执行措施定性不明、新增间接强制执行措施实施效果不佳等问题,严重阻碍了经济的发展、社会的和谐。我们应当在借鉴西方国家合理制度的基础上,制定我国统一的强制执行法,明确间接强制执行原则,进而完善间接强制执行制度,加大间接强制力度,并完善整个社会的诚信保障机制。

DISCUSSION ON PERFECTION OF CIVIL INDIRECT COMPULSORY EXECUTION IN CHINA

Civil indirect compulsory execution,as one of three basic types of civil compulsory execution,plays an important role in compulsory enforcement law.These days,however,there are such problems as the simplicity of legal provisions,the qualitative uncertainty of part of enforcement measures,and the non-efficiency of new compulsory indirect enforcement measures,the backwardness of legislation in such area has greatly hindered economic development and building of harmonious society.Consequently,we should,referring to the rational institutions of western countries,make a unified enforcement law in which indirect compulsory execution should be provided for the purpose of perfecting indirect compulsory execution,strengthening its implementation and further perfecting credit guarantee mechanism as well.
