摘    要:事实劳动关系是劳动法领域较为突出的问题,《劳动法》对此没有明确的规定,虽然最高人民法院关于此问题有相关的司法解释,但其存在立法语义不清、适用不公平、导致法制不统一等缺陷,本文在此基础上借鉴民法中过错责任的原则提出分清责任、明辨是非,合理保护劳动者与用人单位双方利益的修改意见,以期事实劳动关系纠纷能得到法律公平正义地解决。
