| 摘 要： | 鲲鹏模式是为中国模式这一概念提出的一种观念，它的提出无疑是潘维教授做出的重要理论贡献。但是，从德沃金的法律解释学来看，正因为忽视了界定中国模式的概念这项工作的重要性。鲲鹏模式这一观念也存在种种局限。

| Abstract: | The Roc Mode is Professor Pan Wei~ great theoretical contribution to the Chinese Mode. From the perspective of Dworkin＇s theory of law, the Roc Mode has some limitations due to lack of the definition of the concept of Chinese Mode. |
