论污点证人豁免制度在我国的构建

污点证人豁免制度又称污点证人刑事责任豁免制度，是指国家为取得某些重要的证据，或者为追究首要分子的严重罪行，对同案或其他案件中罪行较轻的罪犯做出承诺，如果他们提供某些关键的证据，将不再对其进行刑事追究的一种制度。文章从污点证人和污点证人豁免制度的概念出发，分析了我国建立污点证人豁免制度的必要性与可行性，并提出了建立适合我国国情的污点证人豁免制度的初步构想。

On Tainted Witness Immunity System

A criminal witness ＇is a person who commits a crime, in order to lighten or avoid his criminal responsibility; he is supposed to cooperate with country＇s judicial authority. As a prosecutor witness,he alleges other offenders＂ criminal facts. Thus he enjoys the total or part exemption of his crime. In the meantime, a sound corresponding mechanism for the protection and punishment of tainted witnesses is urgently to be built up. By borrowing foreign exemption systems of criminal witness; the exemption systems of criminal witness with accordance to China＇s situation is discussed in this paper.
