经济安全与知识产权法

包括知识产权法在内的法律具有保障经济安全的作用。但我国知识产权法在保障经济安全方面存在诸多缺陷。我国知识产权立法一方面应顺应世界知识产权保护的发展趋势 ,加强对知识产权人利益的保护以促进微观经济安全 ;但另一方面也应该加强知识产权限制以保障国家宏观经济安全。因此 ,我国应该制定知识产权基本法 ,在立法上建立知识产权预警制度和适用市场经济的科技发展支持制度 ,同时在现有立法中建立健全知识产权限制、反垄断审查等制度。

Economic Security and Intellectual Property Rights Law

All laws, including the intellectual property rights (IPR) law, have the function which can safeguard economic security, but IPR law in our country has many flaws in it. On the one hand, our legislation should comply with the tendency of the world IPR protection, which can strengthen the IPR owner's benefit in order to promote the microscopic economic security. On the other hand, we also should strengthen the limitation of IPR to safeguard the country macroscopic economic security. Therefore, we should formulate the fundamental law of IPR, establish the IPR early warning system and the technical development support system which is suitable for the market economy, and perfect the institutions in the existing legislation such as IPR limitation, counter- monopoly examination.
