制度性弱者权利保障初探

社会主义宪政体制注重保障人权、呼吁平等,却因制度性机会分配不均衍生出选举权、知情权等不被保障的制度性弱者一隅.和生理上、能力上的弱者不同,此种弱者群体为制度所困,受损权利更加隐蔽,其权利保障问题更值得研究.

A probe into the guarantee of the right of the weak caused by the system

The socialist constitutional regime attaches great importance to the guarantee of the human right and appeals to equality. How- ever, owing to the unfair distribution of system chance such as the election right, knowing right, etc, the weak come into being. Unlike those who are weak physiologically or in ability, the weak are perplexed by the system and their rights are harmed in a more hidden way. So their right guarantee is worth studying.
