《宪法》第四章技术性调整探析

《宪法》第四章经过十届全国人大二次会议的修正后，现在依然存在着四个值得考虑的技术性问题，这些问题可以归纳为三个方面：第一，某些词语采用不当，由此引起概念混淆，立法原意不能得到准确表达；第二，新增加的条款在排列时采用了与原来不同的原则，由此造成了排序上的紊乱；第三，个别条款只言其一不言其二，由此影响了条文内容的完整性，也给法律造成了漏洞。为此，宪法第四章有必要再作一些技术性调整，从而使它更加完善。

Technical Adjustment of the Fourth Chapter in the Constitution

After being revised on the second session of the tenth National People＇s Congress, the Constitution still has four technical problems in its fourth chapter that are categorized in three aspects. First, inappropriate use of some words has led to the confusion of some concepts, rendering the inaccurate expression of the legislative intention. Second the newly added articles use different arranging principles from the existing articles, generating the disorder in arrangement. Third, the meaning of some articles have not been fully expressed, affecting the integrity of the Constitution and leaving legal loopholes. Therefore, it is necessary to make some technical adjustments to the fourth chapter to make it as perfect as possible.
