| 摘 要： | 克减条款是人权公约的"基石",对克减条款的保留是一个非常重要的问题。针对人权公约的特点以及克减条款的重要性,结合国际人权机构的实践,如何判断对克减条款的保留是否符合人权公约的目的和宗旨的具体标准进行了阐述,并结合人权公约的特点、克减条款的重要性来解决克减条款的保留问题。

| Abstract: | The derogation clause cornerstone of human rights convention, the reservation of which is key issue. This article analyzes the characteristics of the human rights convention and the importance of derogation clause. Considering the practices of international human rights organs, the author expresses his viewpoints about how to judge whether the reservation of derogation clause is compatible with the objective and purpose of human rights convention. In addition, the author discusses the reservation of derogation clause from the perspective of the characteristics of human rights convention and the significance of the derogation clause. |
