论海峡两岸民商事区际司法协助

海峡两岸民商事区际司法协助是两岸法制发展的热点问题.以2009年《南京协议》为视角,运用调查研究、文献研究等方法,检视和思忖协议签署后两岸区际司法互助面临的主要问题及产生的原因.两岸应信守协议约定,尽快充实各自法规,秉持互信原则,协商解决协议适用引发的争议,以推动两岸民商事区际司法协助健康、有序地发展.

Interregional Reciprocal Legal Assistanceacross Taiwan Strait in Civil and Commercial Matters

The Agreement to Combat Crime and Reciprocal Legal Assistance across the Taiwan Straits, signed on April 26, 2009 in Nanjing, is to deal with the interregional reciprocal legal assistance in civil and commercial matters. Itowever, because the protocol is merely a framework agreement, the contents are relatively superficial. Both sides of the Taiwan Straits need to negotiate with each other and supplement the agreement. This paper tries, with the illustration of the main idea of interregional reciprocal legal assistance across the Taiwan Straits, to analyze the main problems that interregional reciprocal legal assistance across the Taiwan Straits has confronted with, and finally proposes some suggestions on improving interregional reciprocal legal assistance across the Taiwan Straits.
