浅议行政组织制度研究中的三个重要问题——一个比较法的初步研究

行政组织制度研究作为行政法学研究中的重要领域,在我国并没有得到应有的重视。从研究方法上讲,行政组织制度研究应当基于法学的视角而进行,否则将无从定义其学科的特殊性。行政组织的定义在内涵和外延上不同国家之间差别并不大,但就行政组织制度的具体研究内容而言,由于宪政体制等的不同,同一称谓（比如＂行政主体＂）所表达的具体含义国与国之间可能会有较大差异,在学术借鉴时需谨慎识别。

Discussion on three important problems in the research of administrative organization system

The research of administrative organization system is an important subject in the research of administrative law,which does not draw the deserved attention.As for the research method,the administrative organization system research should be done from the perspective of law.Otherwise,its specialty as the subject can not be defined.The definition of administrative organization has no big difference in intention and extension among different countries.But as for the specific research content of administrative organization system,owing to the difference of constitutional system,the specific content of the same term has great difference among different countries.It is necessary to distinguish them in the academic research.
