| 摘 要： | 随着经济社会的发展,市场环境常使得原初缔结合同时的形势发生根本性的变化,情事变更原则的适当和适度应用成为法律实践中的重要关注点。阐述情事变更原则的概念,并探讨商业风险和情事变更的几点主要异同,提出我国司法实践中对情事变更原则的判定以及建议,以期对社会合同管理有所裨益。

| Abstract: | With the rapid development of economy,the initial situation of the execution of contract may be fundamentally changed due to the market circumstances.The adequate and appropriate application of the principle of changed circumstances becomes the important concern in the legal practices.This article tries to explore the concept of the principle of changed circumstances,analyses the differences between this principle and commercial risk,discusses the criteria standards and suggestions of this principle in the legal practices in China,and hopes to benefit the development of theory and practice. |
