| 摘 要： | 随着诚实信用原则地位的提升,有论者言其可取代保险法上的最大诚信原则。而从静态理论层面和动态实践层面对比诚实信用原则和最大诚信原则,可分析得出二者在内涵、调整对象、法律地位、适用环境及适用原则上均存在很大不同,最大诚信原则于保险法上有其理论和现实的必要性。

| Abstract: | With the extending of the modem faith principle, someone have view that it will replace of the utmost good faith principle of Insurance Law. But comparingthe modem faith principle with the utmost good faith principle from Theoryand practice, there are so different on content, object, status, and so on. It is necessary of the utmost good faith principle of Insurance Law on theory and practice. |
