论不动产物权登记之效力

不动产登记不仅有物权变动的登记即移转登记,而且包括其他事项的登记如宣示登记、异议登记、更正登记、预告登记等。学者在论及不动产登记之效力时,多述及移转登记之效力,而对后几种登记之效力似乎不为重视。我们拟从移转登记和保障登记两个方面总结不动产登记的法律效力,以及对不动产法提出一些分析,并与中国的物权法草案建立联系。

Effects of the Registration of the Real Estates

Registration of realty contains not only registration of the fluctuation of the realty,i.e.,transferring registration,but also that of something else such as registration of notice,dissention,correction and advance notice,etc.When discussing effectuation of registration of realty,scholars always argue more about transferring registration while give little attention to the rest kinds.We now try to conclude the legal effect of the registration of realty on the two sides of both transferring registration and ensuring registration,and provide some analysis on real law,which firmly relates to the draft of Chinese real law.
