传统知识地方立法保护初探

随着现代科学技术的发展,传统知识的价值越来越为人们所认识并日益得到广泛利用,因而拥有传统知识的社区、民族和国家尤其是发展中国家要求法律保护传统知识的呼声越来越高。然而,大多数传统知识产生的年代久远、属于集体创造和口头传播,很难利用现行知识产权制度予以保护。因此,有必要在分析现行知识产权制度保护传统知识的实践与局限性基础上,探索其他的法律保护形式。

A Preliminary Discussion of Protection of Conventional Knowledge by Local Legislation

The development of modern science and technology has resulted in the increasing understanding and wide application of the value of conventional knowledge. Therefore, the community, nation and country with conventional knowledge, developing country in particular, are making earnest appeals to protect conventional knowledge through legal methods. However, since most of the conventional knowledge has a long history and is the collective work and is orally spread, it is rather difficult to protect it with the current system of intellectual property. As a result, it is necessary to seek other forms of legal protection on the basis of analyzing the practice and restrictions of protecting conventional knowledge with current system of intellectual property.
