| 摘 要： | 我国《商标法》规定商标实行自愿注册原则,在我国存在大量的未注册商标成为其受到保护的现实基础,未注册商标本身具有的经济价值是其受到保护的经济基础,公平公正更是其受到保护的价值基础。我国《商标法》及《反不正当竞争法》对于未注册商标都没有明确其法律地位,对其保护的规定不完善,建议明确未注册商标的法律地位,确定保护范围;给予未注册驰名商标与注册驰名商标同等的法律地位;完善未注册商标权利人的权利。
