试论新自然法理论的基本观点及其特征

鉴于传统自然法学派与历史法学派，社会法学派和分析实证主义法学派之间的矛盾，新自然法理论家对古典自然法进行了适当的修正，企图搭建起不同法学学派与自然法学派之问的对话平台。新自然法学派的基本思想是：法律和道德是不可分的，正义或自然法是权威和法律的基础，法学研究的核心对象是道德价值，自然法或实践理性具有客观性。新自然法思想具有继承性、创新性、调和性、渗透性和现实性等特征。

On the Fundamental Ideas and Characteristics of the New Natural Law Theory

In view of the obvious contradiction between school of natural law and the schools of historical jurisprudence,social jurisprudence,and analytical positivism jurisprudence,the new natural law theorists have made some amendments to the classical natural law,trying to construct a platform for the dialogue between the school of natural law and others.The fundamental ideas of the new natural law are that law and morality can be separated from each other,that justice or natural law is the foundation for the authority or law,that the core object of the jurisprudence is moral value,and that natural law or practical reason is objective.The new theory of natural law is characterized by its inheritance,creativeness,compromise,permeation and actuality.
