关于不动产预告登记制度的探讨——兼评《物权法》第20条之规定

预告登记是与本登记相对应的一项特殊的不动产登记,其目的在于保全关于不动产物权的请求权,它对于保障不动产交易安全,完善我国的不动产登记制度有着相当重要的作用。我国《物权法》虽然从预告登记的依据、范围、效力等方面进行了规定,但相对比较抽象,缺乏可操作性,因此应在借鉴国外先进立法经验并结合我国实际情况的基础上,对其加以修改完善,以建立一整套切实可行的预告登记制度。

On Registration of Caution for Real Estate

As a special registration for real estate,registration of caution aims to protect the right of claim for real estate.It will play a major role in maintaining the safety of real estate transaction and improving the registration of real estate in China.The stipulations for registration of caution concerning the guideline,scope and effects in Real Right Law are rather abstract and therefore render uneasy practical operations.We shall refer to the foreign legislation experiences while considering our own real situations in order to establish a feasible registration of caution in China.
