| 摘 要： | 从立法的本意看,将立案作为刑事诉讼的首要环节有着特定的价值。但由于对立案这一程序的行为内容、法律性质、地位以及与其他诉讼环节的关系等问题的认识上的偏差,导致了立案程序的立法本意与司法效果出现了严重的背离。因此,建议取消独立的立案程序,将其纳入侦查程序之中,以求整个刑事诉讼程序的顺畅和连贯。

| Abstract: | From the perspective of the purpose of legislation,taking filing as the primary part of criminal procedure is of special value.However,the difference in the understanding of the action content,legal nature,status,and the relations with other elements in filing procedure results in serious deviation between the original legislative purpose of filing procedure and legal consequence.Therefore,canceling independent filing procedure and taking it into investigation procedure are suggested to achieve the smoothness and coherence of criminal procedure. |
