高校学生管理法治化中的常见问题及其对策

当前高校学生管理中的法律问题日渐增多，其原因在于现代社会多元文化价值观对高校学生管理的观念影响、现代法治观念对高校学生管理的影响、陈旧的高校学生管理模式与现代大学发展之间的矛盾以及立法实践与高等教育法学理论研究的滞后等。目前在高校学生管理当中常见的违法现象主要有实体性违法行为和程序性违法行为两大类。针对这些问题，高校应当从树立以人为本的教育观、培养现代法治精神和意识、健全高校制度建设和加强高等教育法学的研究和普及等方面加以解决。

Legal Management of College Students: Problems and Countermeasures

At present,legal issues in the management of college students have been increasing because of the impact of the contemporary multi-polar cultural values on the management concept,the impact of the modern concept of rule of law on the management of college students,the contradictions between outdated management mode and the development of the modern universities,and the lag of legislative practice and research on higher education law theory.For the moment,in the management of college students,there exist two major categories of illegal phenomena-the substantive and procedural illegal acts.To solve these problems,a people-first concept of education should be established with the cultivation of a modern spirit and awareness of the rule of law and management of the college system building and strengthening of research and prevalence of higher education law in the university.
