| 摘 要： | 建设工程价款优先受偿权是法律赋予建设工程承包人优先受偿的权利。但是现有的法律对该权利的具体规定很少，导致很多争论，对该权利的行使产生不利影响。我们可通过分析和探讨相关学说和法律规定，对建设工程价款优先受偿权的法律性质、行使，与工程垫资的关系，与抵押权、消费者权利的竟合等问题进行研究。

| Abstract: | Priority of compensation of construction project is a right which is endowed with contractor by ＂contract law＂. However, there are very few articles of law about this right. The status leads up to controversy about this and makes against exertion right. We can research problems about priority of compensation, legal character, exercise the rights, prepayment for construction, concurrent with consumers＇ rights by analyzing the theory and law. |
