吴经熊:超越东西方的法学家

在中国法学史上,吴经熊占有一个特殊和引人注目的位置。吴氏早年游学欧美,精研西学,试图建构超越东西方的法律哲学,达到"恒常"与"无常"、"守经"与"达变"之间的圆融与会通。面对内忧外患的国难当口,吴氏中年皈依天主教,沉浸灵修,提出"在进化中的自然法",期许实现法律真、善、美三者相和谐的艺术。时隔半个世纪,作为法律学人重新回味吴氏其人其学其思想,检讨其中的得失,以期为我国的法治建设带来些许思考。

Wu jingxiong: Legist beyond East-West

In the history of law in China, Wu Jingxiong occupies a special and compelling position. During his early years, Wu pursued his study in Europe and the United States, attempting to build philosophy of law beyond the East-West and to achieve the harmony between ＂eternity＂ and ＂impermanence＂, ＂abide by＂ and ＂up to change＂. Seeing that his own nation suffered from internal and external problems, Wu converted to Catholicism at his middle age, immersed in spirituality, proposing ＂in the evolution of natural law＂ in order to achieve the harmony of legal truth, goodness and beauty . Half a century later, as a legal person we review Wu＇s thought and test the pros and cons of them in order to bring a glimpse of thoughts about the role of law in China.
