村规民约与相关法律规定冲突之思考——以农村出嫁女的土地权益受侵犯为视角

近年来,出嫁女要求土地赔偿金等维权案件呈现上升趋势,而这些案件大多是因当地的村规民约以"民主决策"的名义所行的侵犯妇女合法土地权益的行为所致。村规民约是村民自治的体现,但其内容必须符合相关法律的规定,同时,对村规民约的合法性应当由特定的机构予以审查,以便明确其违法的法律责任及可诉性。

Reflections on the Conflicts Between Self-Restraint Villager Agreements and Legal Regulations

In recent years,more and more married female villagers sue for their legal rights when violated by residents committee in the name of local non-governmental agreements.As a kind of symbol of self-governing,those agreements must abide by legal regulations concerned;and a certain department of the government,on the other hand,should be authorized to exam the validity of those agreements.
