法治信仰缺失论

我国目前已建立了比较完备的社会主义法律体系。但＂徒法不足以自行＂,欲使该等法律之光普照中华大地仍需借助于执法环节。然就当下的执法现状而言,＂选择性执法＂现象始终存在,法治离我们依然遥远。这种状况之所以长期存在,主要是因为＂法律工具论＂的幽灵仍然支配着执法者的法治观念。同时,这种状况的长期存在致使整个社会缺乏对法治的信仰,社会主义法治的实施基础无从建立。

THE DISCUSSION ON THE LOSS OF BELIEF IN LAW

China has established a relatively complete socialist legal system,but ＂only method is inadequate to operate on its own＂,in order to make the light of these laws shine on the land of China,there is still in need to enforce the laws. However,as for the current situation of the law enforcement,the ＂selective enforcement＂ phenomenon has always existed,the rule of law is still far away from us. The main reason is that the ghost of ＂legal tool＂ still dominates the notion of law excutor. At the same time,this situation makes the whole community lack long-standing belief in law. The basis of the implementation of socialist rule of law can not be established.
