| 摘 要： | 刑法注释学属于刑法学的一个分支学科，它以成文立法——《中华人民共和国刑法》为主要研究对象。从注释法学派的发展，注释法学的特征、功能及必要性等方面做以阐述，揭示注释刑法学自身的价值及研究的重要意义所在。呼吁法学界能给予注释法学更大的发展空间，借此推动我国刑法学乃至中国法学的长足发展。

| Abstract: | The theory of explanatory criminal law,which mainly researches into the written law The Criminal Law of the People's Republic of China,is a subdiscipline of the science of criminal law.This paper reveals the value of the theory of explanatory criminal law through elaborating the development,characteristics,functions and necessities of glossators.It makes an appeal for the attention of the law circle to the further development of glossators so as to promote the rapid development and the maturity of the science of criminal law,even the science of Chinese law. |
