| 摘 要： | 惩罚性赔偿制度是英美法系国家普遍采用的一种法律制度，在救济受害人、惩戒加害人等方面具有特殊的价值。在我国法律制度中吸收和借鉴惩罚性赔偿制度具有重要的现实意义。

| Abstract: | The system of exemplary damages is universally adopted similar legislation system. It has special value in relieving the aggrieved significance that China takes in and learns from the system of exemplary in countries such as Britain and the U.S. which have party and punishing the inflictor. It is of great realistic damages. |
