| 摘 要： | 辩论原则是我国民事诉讼法的一项基本原则。辩论原则的非制约性必然导致辩论原则的非原则化。必须借鉴大陆法系辩论主义的精神实质，重新设计我国民事诉讼法的辩论原则。
