| 摘 要： | 近年来,随着网络侵权案件的层出不穷,网络服务提供者在网络侵权中的法律责任备受关注,而其前提是合理地确定网络服务提供者侵权归责原则,本文通过分析网络侵权行为特殊性,评述我国的立法现状,提出根据网络服务提供者的不同分类及不同侵权行为来合理确定网络服务提供者的侵权归责原则,构建以过错责任原则为主,无过错责任原则和公平责任原则为辅的归责原则体系,有效的平衡各网络主体之间的利益冲突,促进网络社会和谐美好的发展。
