加快推进反腐败国家立法研究

全面依法治国背景下,“依法反腐”成为必由之路,提出依法反腐首先要加快反腐败国家立法。关于推进中国反腐败国家立法的模式,宜采用多数专家学者主张的集中立法模式,即针对腐败进行专门立法。在此前提下,制定统一的反腐败法典应尽快纳入立法规划,做好顶层设计。加快推进反腐败国家立法的基本思路是坚持“立法先行”与“立改废释”并举,做好制定反腐败法典的顶层设计,同时应抓紧制定单行反腐败国家立法。此外,修改完善散见于其他部门法的反腐败法律规定,以充分发挥其他部门法的作用。

Developing the National Legislation to Fight Corruption in China

In the context of rule by law, 'anti-graft' according to law has become inevitable. The paper proposes that to fight against corruption under the rule of law our country must develop its national legislation, the centralized legislative mode advocated by most experts and scholars can be adopted in China, unified anti-corruption code should be introduced into the legislative plan as soon as possible. The basic thought about promoting the national anti-corruption legislation is to adhere to “legislation first” and “legislation to change the waste release” simultaneously, draw up a top-level design of anti-corruption law, develop a single national anti-corruption legislation, revise and improve the parts in other branches of law concerning anti-corruption laws and regulations in order to give full play to the role of the law in other departments.
