中国宪政建设模式研究

宪政建设模式分为政府主导型与社会演进型,中国采用政府主导型的宪政建设模式是历史的必然选择,其基本特点是：动力充足性、发展赶超性和成本低廉性。但是,这种模式也存在不足：可能导致宪政建设的内在基础危机和制度支撑匮乏,宪政建设的结果可能是一种高度的有限宪政制度。从这种宪政建设模式中得到的启示是：分阶段建设、渐进发展道路和过渡性。

Study on China's Construction of Constitutionalism Pattern

Construction of Constitutionalism patterns fall into two categories: government-dominant pattern and society-evolved pattern.It is an inexorable choice of history for China to adopt government-dominant pattern as its Construction of Constitutionalism pattern.This pattern has three characteristics: sufficient motive force,surpassing development and low cost.However,there one also disadvantages in this pattern.It may bring about an inner basis crisis and deficiency in system support.Moreover,the consequence of this pattern may be a highly limited constitutional system.Therefore,some enlightenment can be gained from this Construction of Constitutionalism pattern: step-by-step construction,gradually developing path and transition.
