市民社会:现代法治形成的逻辑起点

现代法治理念的型塑、体系的建构及其在社会中的传播，其首要的前提与基础是现代市民社会的形成与发展。从发生学的视角来审视，现代法治是在近代以来市民社会充分发展的基础上萌芽和发展起来的；从事实判断的视角来审视，现代法治的整个理论体系是在市民社会与政治国家逻辑互动的基础上建构起来的；从价值判断的视角来审视，现代市民社会的积极成长使现代法治真正实现了对传统人治或礼治的超越，井为实现人的全面发展奠定了坚实的基础。

Civil society: the logic starting point of the forming of the modern legal government

The first and utmost precondition and basis for the forming of the modern concept of legal government, the establishment of its system and its spreading in the society are the forming and development of the modern civil society. From the perspective of genetics,the modern legal government is germinated on the basis of the full development of the civil society in the modern times. From the perspective of the fact judgement, the whole theoretic system of the modern legal government is established on the basis of logic interaction between the civil society and politic state. From the perspective of the value judgement, the positive development of the modern civil society makes the modern legal government transcend the traditional government by man or by etiquette, laying the solid foundation for the full development of people.
