| 摘 要： | 住房按揭保证保险是一项备受争议的险种。对其性质认识的不同，导致了司法实践中纠纷解决途径的不统一。我国现行的按揭住房保证保险制度因缺乏立法和理论支撑而存在法律适用的问题、强制保险与民商法基本原则相违背的问题、保险过度的问题和保险人代位求偿权的行使问题。

| Abstract: | The mortgage guarantee insurance of housing has been in dispute since it was adopted in China. The different opinions in its nature result in the different remedies in judicial practice. Due to lack of legal and theoretical support, current mortgage guarantee insurance of housing system has the problem of legal application, the problem of contraction between compulsory insurance and the basic principles of civil and commercial laws, the problem of over - insurance and the problem of imolementation of subrogation right of insurance applicant. |
