“无财产即无人格”辨

无财产即无人格,作为民法学上对财产与人格关系的认识命题之一,在学界有很大影响,但实际上存在瑕疵。通过对财产与人格在民法学上的内涵与外延的界定,重新厘定二者之间的关系,基于民法哲学上＂人文主义＂价值理念的考量,从理论上论证无财产即无人格的不足,又结合古今中外民法立法实践,在实践上予以反驳,并试图探寻和凸显近现代民法的基本理念和价值,即摒弃物文主义,让人文主义复归。

Refutation about"No Property,No Personality"

The proposition of ＂No property,no personality＂ reflects the understanding of the relationship between property and personality in civil law.Although with great influence in academia,it has some defects in real life.This paper defines the connotation and denotation of the property and personality in civil law and explores their relationship.Then it theoretically discusses the defects of this proposition on the basis of humanism and rely on the legislation practices through all the ages in the world to refute.The purpose is to discover the basic concepts and values in modern legislation--replace materialism with humanism.
