| 摘 要： | 拘役刑的执行地应为一审法院所在地,执行机构为看守所;执行机关应将组织拘役犯进行劳动作为自己的原则,创造条件组织进行合适的劳动改造;是否准许罪犯回家应主要取决于是否会影响剩余刑期的继续执行,将假期折抵刑期弊大于利。

| Abstract: | The execution place of the detention penalty must be the one where the court of first instance is located,and the execution organ must be the detention center.The principle of the execution authority should focus on getting all the detention criminals involved in the labor,creating the conditions to organize them to do the appropriate reform through labor.When we decide on whether to permit criminals to go back home,it mainly depends on whether this action will affect the proceeding execution of the rest term of imprisonment,and the disadvantages will outweigh the advantages if we exchange the vacation periods for the term of imprisonment. |
