| 摘 要： | 《刑法修正案(八)》明确将危险驾驶入罪。对危险驾驶行为的定罪,改变了"肇事后再处罚"的方式,将醉驾等危险驾驶行为的规制正式法律化。但在司法实践中,其规定存在着不足。该文讨论了危险驾驶罪发生的原因、主要特点以及办理案件中存在的问题,提出了对危险驾驶罪的几点建议。

| Abstract: | In ＂Criminal Law Amendment （8）＂, it is clearly provided that dangerous driving is convicted. The conviction of dangerous driving, changed the current situation of ＂ accident after punishment ＂, change the dangerous driving behavior such as dangerous driving into a formal legal system. In practice, there are some deficiencies in its provisions. In this article we put forward some suggestions on the crime of dangerous driving based on crime causes of dangerous driving, main characteristics and the problems existed in legal case in reality. |
